Laird, L 14s 9s 7d. Totals— 3B creditors, liabilities, L 2852 6s 6d. Mr Har.kins objected to Mr T. King's proof of debt being received, on the following grounds: — .(1.) That as far as Turnbull and Co. and Duthie are concerned, on the dissolution of the partnership of King Brothel's, Thomas King was released conditionally on his assign* ing all the assets of the firm to James King for a nominal consideration. (2.) That as to the other creditors of the debtor represented by Mr Han kins Thomas King is still jointly liable with James King- to those creditors, inasmuch as he has given them no notice of hjs retirement from the firm, consequently being jointly indebted with his brother to these creditors he cannot prove on the estate, Mr Perkins replied, contending that the only duty of the Chairman was to see that the proof of debt was m proper farm. %he of

validity of the proof must be left to the trustee. Mr Hankins said the proof of debt might affect the election of trustee, by assisting the election of one favorable to Mr King. The Chairman quoted the Act as stating inferentially that any proof should be accepted at the first meeting, provided it were m propel form. Only an ex par te statement had been made by Mr Hankins a.against the sworn proof of Mr T. King. Hence he must allow the proof. Mr Rutherford then moved, as proxy for E. H. Ciease, " That C. E. Capper and W. Dawson, both of , Wellington, be appointed trustees m the estate." Seconded .by Mr Hankins, as proxy for Neil and Co. Mr Perkins said that he and those "who were voting -with him were determined to oppose the- ap-» pointment of Wellington trustees Experiences m that direction had been unfortunate. In Brightwell's estate, 8s m the £ was taken up m expenses of administration. On a vote being taken 15 creditors representing L 1703 12s 5d voted for the motion, and 23 creditors repre« senting LI 148 14s Id against it. The requisite majority m both number and value not being obtained,fche motion was declared not carried. After further discussion the meteting was adjourned until 11 a.m. today.
