KoHunu-TuKUROA Block. Appeal No. 19.—8y Te Rahui Hoera and others. This appeal was withdrawn by Mihaka Matika at request of appellant on the sth February, 1907. Appeal No. 20.— -By Tamehana te Puia and others. This appeal was withdrawn by appellant on the Ist March, 1907. We therefore recommend that appeals 19 and 20 be dismissed. Appeals Nos. 17 and 18.— By Numia Kereru and Te Wharepouri te Amo, respectively. The second of these appeals—No. 18—objects to certain persons in the order, and much evidence was given Under Numia's appeal—No. 17—a request was made that the block, be partitioned by the surveyed line shown in Plan No. 6849a, commencing at Te Taimatua and extending to Te Raepohatu, Numia claiming that portion of the block north of the said boundary-line, including also the part which he says was wrongfully included in Tarapounamu Block. We have duly considered these two appeals, and we make the following recommendations: — (1 ) The persons now objected to were submitted for inclusion by Numia's party themselves at last Commission as proper owners in their own right. This appeal should therefore be dismissed — i.e., Appeal No. 18. , . . . . (2 ) In regard to the request that the block be partitioned, in our opinion a long period ol time would be occupied in duly and carefully ascertaining the proper persons having rights as owners in each of the two portions of the block if so divided. We think that it_ should properly be left to a subsequent Partition Court to divide the land if partition is applied tor, and that therefore that part of this appeal should be dismissed. , . (3 ) In regard to that portion of this block alleged to have been wrongfully included in Tarapounamu Block by last Commission: Numia has not lodged any appeal in reference to the Tarapounamu Block, but appealed in regard to Kohuru-Tukuroa Block only, and states that he thought it would be quite competent under his appeal therefor to deal with that portion also of this block which he alleges has been included within the boundary of rarapounamu Block. Evidence was given before us alleging that a certain burial-place containing dead and certain kaingas, belonging to Numia Kereru and Ngati Rongo Hapu, have been wrongfully included in the Tarapounamu Block, if such assertion can be credited; but as they lodged no appeal in regard to this matter we have therefore no recommendation to make. The seven persons whose names are hereunder set out are the persons who have been selected by the owners of this land from amongst their number and proposed by them as the memhvcsjor the Hapu Committee for this block, and agreed to by all the owners present before this Commission sitting at Whakatane on the Bth day of March, 1907 :— 1. Aweals Nos. 21 and SSl.— These appeals were inquired, into by this Commission, and after much evidence had been taken an arrangement was mutually arrived at between the contesting Trties as to fte matters in dispute, which was subsequently submitted by them to the Commission aid asked to be carried into effect, all parties signifying their consent thereto i.e.: — It regard to Appeal No. 21 by Paora Kingi, claiming inclusion of himself and certain other persons twenty-seven in all, and Appeal No. 22 by Tupara Tamana for inclusion of oertampersone forty S in all, who were omitted at time of last Commission, it has been agreed that these wvpntv-one persons be added to the list of owners. Tie said seventy-one names with individual shares as shown have accordingly been added by us to the list of owners in the order for this block, and therein numbered respectively from 218 to 356, both inclusive. . , , We recommend that this mutual arrangement be giv<*n effect to as asked.
