SUPPLY OF RADIO SETS TO PUBLIC WORKS WORKMEN.
Memorandum of Agreement between the National Council op the Young Men's Christian Associations of New Zealand and the Minister of Public Works. An agreement made this twentieth day of August, 1937, between the National Council of the Young Men's Christian Associations of New Zealand a body incorporated under the Religious Charitable and Educational Trusts Act, 1908, and having its registered office at number 114 The Terrace, Wellington (hereinafter called the Council) of the one part and His Majesty the King acting by and through the Minister of Public Works (hereinafter with his successors in office referred to as the '' Minister ") of the other part: Whereas in an endeavour to improve the conditions of life for workmen employed by the Minister on isolated works the parties hereto with the assistance of representatives of those engaged in the trade or business of selling radio receiving apparatus have for the purpose of facilitating the purchasing of radio receiving apparatus by such workmen devised a scheme under which the Government will provide the finance and the Council will provide the selling organisation : Now therefore in consideration of the loan by the Minister of the sum hereinafter referred to (the receipt whereof is hereby acknowledged by the Council) it is agreed between and by the parties hereto as follows that is to say : 1. The Minister shall lend to the Council for the period hereinafter provided the sum of one thousand pounds (£1,000) to provide a fund for the purchase of radio receiving apparatus in accordance with this Agreement. 2. The term of the said loan shall be three years or until such time as a period of two months shall have elapsed without any fresh application for the purchase of radio receiving apparatus being received by the Council, whichever is the shorter. 3. Separate account shall be kept by the Council of all transactions arising out of the scheme and such transactions shall not be included in the accounts of the general activities of the Council. 4. The Council shall pay to the Minister on the last days of March, June, September and December in each year interest on the said sum of one thousand pounds at the rate of five per centum per annum. 5. The Council may at any time or from time to time without notice repay the whole or any part of the loan moneys and thereupon interest charges shall cease to accrue due on the sum repaid. 6. On the determination of this Agreement the Council shall pay to the credit of the Public Account the loan of £1,000, hereinbefore referred to or such part of it as after audit is found to be correct. 7. The Council will make with the Suppliers of as many different kinds of radio receiving apparatus as may be agreeable (hereinafter referred to as " Suppliers") contracts or business arrangements under which such radio receiving apparatus will be available to the Council on the terms customary in the trade at prices not exceeding the lowest wholesale price thereof, together with one fourth additional; and such contracts or arrangements shall provide for delivery to the Council at the Camp Hut or if no Hut, at the premises of the Agent of the Supplier nearest to the Public Works Camp where the workman resides : 8. As and when funds permit the Council shall entertain applications from workmen employed by the Minister for the purchase of radio receiving apparatus ; provided that no application shall be entertained from any workman who already has a radio receiving set or the principal parts thereof at the time of such application or at any time between the date of execution of this Agreement and the time of such application, or who recently returned to the Supplier any set on which the Agreement of purchase was not fulfilled, unless the Minister consents to such application. 9. The Council will permit the workman to select radio receiving apparatus of any description in respect of which it may have then arranged terms of purchase with the Suppliers ; provided that no radio-receiving apparatus operated from batteries shall be sold under this Agreement if the price thereof on sale to the workman assessed in accordance with this Agreement would exceed Twenty Pounds (£2O) and no other radio receiving apparatus shall be so sold if such price would exceed Fifteen Pounds (£15): 10. The price to be charged by the Council for each set of radio receiving apparatus sold to a workman shall be ascertained by adding fifteen per centum (15%) to the sum payable for such set by the Council : 11. The proceeds of the additional 15 per centum referred to in the last preceding paragraph shall be credited to a separate Account (hereinafter referred to as the Stabilisation Account) which account shall be utilised by the Council for the following purposes : — (а) Paying the expenses incurred by the Council in handling the radio receiving apparatus sold under this scheme. (б) Meeting bad debts and trading losses and other expenses incurred by the Council under this agreement.
