GISBORNE APPEAL CASE

The )case of Ritchie v. Hall was argued in the Court of Appeal this morning. This is an appeal from the decision of Judge Conolly. Respondent carries on business as a painter and plumber at Gisborne, and appellant was in his employ as manager and foreman in the plumbing department. Appellant met with an accident in April, 1902, and was in the hospital at Gisborne until August, 1902. He was at Rotorua until December, and in Wellington for
further treatment until January, 1903.
Appellant in the present action claimed £llß for wages during the period in question. The case was heard at Gisborne before Judge Conolly without a jury in April last. Judge Conolly found that appellant was entitled to a week’s wages only in lieu of notice, and gave judgment for that amount and costs, as in the Magistrate’s Court. The appeal waß heard by the Chief Justice and Judges Denniston, Edwards, and Cooper. Messrs Skerrett and Jones appeared for the appellant, and Mr Gray for the respondent. Judgment was reserved.

At the Appeal Court to-day the case of Ritchie v. Hall was argued. Messrs Skerrett and R. N. Jones appeared for appellant, and Mr Gray for respondent. The argument principally turned on the question of whether the contract for service had been mutually abandoned owing to the appellant’s illness. Judgment was reserved, and will be probably given at the conclusion of the sittings.
