An important appeal case came before Judge Conolly, whou tho Truant Officer to the Auckland Education Board uppealed ftoainst tho deoisiou of tho Justices of tho Peaco in a enso in which the defondant nleaded guilty to a broach of tho School Attendance Act iu not sending his boy to aehool. and in which tho Justices dismissed tho case on the ground that tho offonce was a trivial one. His Honor said tbo facts seemed to bo admitted. The do 'iendant ploadod guilty, and tho case was dismissed by tho Justices under Section 87 of tho Justices of tho Poace Act, on tho around that tho offenco was trivial. If the Justices considered the case trivial fchov should not bavo accepted a p ea of nuilty, hut should havo heard the case. b Mr Reed, for appellant, said that this <, was taken from a number of cases similarly decided on the same day. His Honor allowed tbo appeal, and ordered the case to go back to tho Justices, expressing tho opinion that tho minimum penalty must be inflicted.
