HAWKE’S BAY ASSAULT CASE.

COURT OF APPEAL JUDGMENT. Press Association. WELLINGTON, yesterday. In the Hawke’s Bay case of, Rex v. Peddle, the Appeal Court, without calling on the defence, gave judgment that Mr. Gutten’s appointment as sheriff was perfectly valid; that it he exceeded his power, as to which the Court expressed no opinion, Peddle’s remedy was by action, and the assault was not justified, and lastl" that if the land was not sufficiently identified that omission was cured' by prisoner’s admission in giving evidence. The conviction was therefore affirmed.
