James Ihorburn, applied for double area claim at Soldier's ; granted. Mr Brennan applied, on behalf of Albert Beard, for a residence area of balf an acre at Antonio's Flat, which was granted. Johnson t. Kidd. An application for the cancellation of a registered tail-race in Lankey's Gully, which has remained unused and abandoned for three or four months. The complainant has used the race for a considerable time, and as his tail* race empties into the race in question, and as the nature of the gold is of a light charater mixed with cement, the gold is carried a long distance, and to prevent the defent dant to come and clean up and take the gold which the plaintiff now runs into the race, the present proceedings were taken to secure the gold to plaintiff from his own workings, and also to secure the right to the race for the future. The defendant said that he holds a certificate for the tail-race, but admitted not having used it for three months. As he has been running his tailings into Ross' tail-race on the other side of the ground, but that he would require the now disputed race again, as he would soon be finished where he now was work' ing. The Warden refused the application with costs. The Court then adjourned.
