MAGISTRATE’S COURT.
TO-DAY’S PROCEEDINGS.
CHARGE OF THEFT.
Mr J. L. Stout, S.M., presided over a sitting of the Alagistrate’s Court at Palmerston North to-day. Hugh Fraser Pirio, a tailor, aged 52, was charged with the theft at Palmerston North to-day of blankets valued at 3os, the property of F. I. Colvin. Accused pleaded guilty. Senior-Sergeant Whitehouse said accused had taken the blankets from an hotel. Accused said that drink had been the cause of his trouble. A sentence of one month’s imprisonment with hard labour was imposed, and an order was made for the return of the blankets. CIVIL PROCEEDINGS.
Action was taken by E. Radomski, farmer, of Kelvin Grove, against J. AlcCool, farmer, of Whakarongo, on a claim for £25 12s, the price of two cows bought from defendant at a clearing sale, plus grazing and loss of profit. Air McLeavey appeared for plaintiff and Air Cooper for defendant. Plaintiff alleged that the cows had failed to calve on the dates given by defendant. One qfime in with only two quarters functioning. The prices had been £7 and £6 10s respectively for the animals.
Cross-examined, plaintiff said that he was aware there had' been conditions of sale, but had not ascertained them.
Evidence was given by Alfred Edward Cowley, farmer, of Whakarongo, that the auctioneer had informed those present at the sale that they could rely with confidence on the dates given by defendant. W. H. Aloffatt, the auctioneer at the sale, said he had informed those present that the dates given had been kept by defendant for his own personal information. The customary conditions of sale had been qiosted up. After hearing legal argument the Alagritrate non-suited plaintiff.' He said the vendor could not be held responsible if plaintiff had failed to attend the opening of the sale and hear the conditions read. It could hardly ho expected, he said, that they should be read with each head of stock offered.
