As requested by your Circular, No. 1,043, of 9th instant, I have the honor to forward to you a Eeturn of Securities for Money filed in this office, upon which satisfaction has not been entered, and which therefore appear upon the records as still " unliquidated." Under " The Bills of Sale Act, 1856," and " The Wool and Oil Securities Act, 1858," only are such securities registerable, and each of these Statutes provides a certain mode of cancelling and satisfying deeds made under it. This proceeding is evidently much neglected by the parties interested; and I deem it my duty to submit my opinion, that the accompanying Eeturn, though strictly accurate as corresponding with the Official Eecords, is calculated to couvey a very erroneous impression. Supreme Court Office, Sir,— Nelson, 30th August, 1867. I have the honor to forward the Return called for in your Circular letter of the 9th iustant, and in doing so I think it necessary to call your attention to the fallacy of drawing any deductions from such Return to be depended upon for statistical or other purposes. In securities over real property a release or discharge is necessarily recorded to discharge the lien, but in securities over personal property great carelessness takes place in filing affidavits of satisfaction, and to my own knowledge in but few cases are such affidavits filed where the property is really discharged of the lien. I should say about three-fourths of the amount shown in the Return are satisfied. Under the Wool and Oil Securities Act, advances are charged on the wool of the ensuing clip of that particular season. I have therefore treated all deeds of previous years as discharged, and have only included in the Return the amounts for the current year. I have, &c, The Hon, the Colonial Secretary, J.
